Recent argument at Court of Appeals of the State of New York

Mr. Hoffner recently appeared at the Court of Appeals in Albany, New York State’s highest court, with his co-counsel Dechert LLP, to argue on behalf of an investor in certain defaulted bonds issued by the Province of Mendoza, Republic of Argentina. The matter had been certified to the New York court from the United States Court of Appeals for the Second Circuit, which after oral argument by Mr. Hoffner in March 2018, requested that the New York court advise it as to whether New York law allows the accrual of interest on time-barred principal. A decision by the New York Court of Appeals is expected in the near future. Question certified by Ajdler v. Province of Mendoza, 890 F.3d 95 (2d Cir. 2018).

Mr. Hoffner recently obtained summary judgment for investment fund clients in an action against a public company based on a default of notes.  Alpha Capital Anstalt and Brio Capital Master Fund, Ltd., 208 U.S. Dist. LEXIS 125379 (S.D.N.Y. July 26, 2018).
